The temporary victory for Kentucky in the case to seize 141 internet gambling domains is already over, as one of the sites that the commonwealth wants to seize has come forward to plead its case.
The Interactive Media Entertainment & Gaming Association submitted an affidavit to the Kentucky Court of Appeals on behalf of Yahtay Limited, which owns TruePoker.com. The site confirmed its membership in iMEGA, thus allowing the case against the commonwealth to continue. The filing was done with the appeals court, which is expected to immediately move the case back to the Supreme Court.
Last week, the Kentucky Supreme Court ruled that iMEGA did not have standing in the court, since it had not proven that it actually represented any of the 141 domains in question. Today’s actions give iMEGA standing, and the case is expected to proceed. The court seemed to be siding with iMEGA against the commonwealth before this setback, so an outcome favorable to the poker sites is expected, now that the case will be allowed to continued.
According to a iMEGA Chairman Joe Brennan Jr:
The owners of the “TruePoker.com” domain have taken a big step on the behalf of the industry and players. We’ve overcome the technicalities that gave the Commonwealth their short-lived victory. The Court can now make a decision based on Kentucky law. Based on the language of the decision last week, we know the Court wants to do just that. We know that the law favors us, and frankly, so does the Commonwealth’s attorneys.
