An interesting collision of two recognizable names within the poker community occurred this week when it became public that Dutch Boyd, he of the legendarily unpredictable behavior, has been sued by 2+2 / Mason Malmuth.
The basics of the suit: 2+2 alleges that Dutch Boyd (Russell Aaron “Dutch” Boyd, if you’re keeping real name score) registered a domain name using the phrase “Two Plus Two” that provider users with poker-related content and linked to sites offering services that compete with 2+2. That, says 2+2, amounts to infringement.
Or, as they state in the suit: “Defendants’ actions have disrupted or are intended to disrupt Two Plus Two’s business by, among other things, diverting web users away from Two Plus Two’s Web sites and forums”.
Boyd has a history of being an active purchaser and developer of various domains. He was involved in a similar situation with PokerHost last year and successfully defended himself in arbitration over the domain complaint. That situation never reached the courts, instead being handled by an arbitration panel at the WIPO.
The domain in question, Twoplustwopoker.com, is no longer active and is now shown as being owned by the attorneys retained by 2+2 for the suit.
Dutch has yet to mention the suit on his blog, but made the following comments in a post on 2+2.
“Mason, if you’re reading this I’m sorry that I registered the domain name. It wasn’t my intention to aggravate you. But there is no way in hell I’m paying $15k for you to drop this case.”
“The lawsuit he is bringing against me is based on a domain name that he currently owns: twoplustwopoker.com. It is without merit and is designed to encourage me to pay him off or face a substantial legal bill defending myself against it.”
“Unfortunately, the strategy will work, and he will be successful in wasting both of our time and money as well as the Nevada taxpayer’s money. The only people who will be coming out ahead in this game is Mr. Malmuth’s overpriced attorneys.”
